These terms govern your use of LandTaxCalculator.com. The most important thing they say: the calculators provide estimates for general information only, and using them does not create a professional advisory relationship. Read on for the details.

1. Acceptance of terms

By accessing or using LandTaxCalculator.com (the “Site”), you agree to be bound by these Terms of Use. If you do not agree to any part of these terms, please do not use the Site. Continued use of the Site after changes to these terms constitutes acceptance of the revised terms.

2. Nature of the service

LandTaxCalculator.com provides free online calculators that estimate land tax (Australia) and land transfer tax (Canada) based on user-supplied information and publicly available government rates. The Site is informational. It does not collect payments, store user accounts, or transmit user inputs to any server — calculations run entirely in your browser.

3. The calculators do not provide professional advice

The calculators on this Site provide estimates for general information only. They do not constitute tax advice, legal advice, financial advice, or professional advice of any kind. Using the Site does not create an advisor–client, lawyer–client, accountant–client, or fiduciary relationship between you and LandTaxCalculator.com.

Tax law is fact-specific and changes frequently. Your actual liability depends on circumstances that a calculator cannot capture, including but not limited to:

  • Your residency status, citizenship, and visa class
  • Ownership structure (individual, joint, trust, company, partnership)
  • Available exemptions, concessions, and rebates specific to your situation
  • Aggregation of land holdings across jurisdictions (Australia)
  • Date of registration, contract date, and settlement date
  • Use of the property (principal residence, investment, business)
  • Pre-existing transfer arrangements, gifts, or court orders
  • Recent legislative or regulatory changes not yet reflected in the calculator

Before relying on any figure shown on the Site for a real-world transaction, you should consult a qualified tax professional in your jurisdiction — typically a registered tax agent or accountant in Australia, or a real estate lawyer in Canada.

4. Accuracy and limitations

We make reasonable efforts to keep the Site’s rate data accurate and current. However:

  • Rates change. Governments update thresholds, brackets, and exemptions regularly. There may be a lag between an official rate change and its reflection on the Site.
  • Worked examples and unusual cases. The calculators model standard scenarios well. Edge cases (off-the-plan apartments, mixed-use property, partial transfers, deceased estates, related-party transactions) may not be modeled at all, or may be modeled with simplifying assumptions.
  • Municipal variation. In jurisdictions where municipal rates differ within a province (notably Quebec and Nova Scotia), the calculator uses representative rates that may not match every municipality exactly.
  • Currency and rounding. Results are shown in CAD or AUD as appropriate, rounded to the dollar. Government calculators may round differently.

If you spot a discrepancy between the Site and an official government source, please let us know — corrections with a link to the official source help us fix issues quickly.

5. Permitted use

You may use the Site for any lawful personal or business purpose, including:

  • Estimating closing costs or annual land tax for properties you own or are considering
  • Comparing tax treatment across states or provinces
  • Sharing the Site’s URL with clients, friends, family, or colleagues
  • Linking to the Site or any specific calculator from your own blog, social media, or website

You do not need permission to link to the Site or to recommend it.

6. Prohibited use

You agree not to:

  • Attempt to gain unauthorised access to the Site, its servers, or any related systems
  • Interfere with or disrupt the Site, including by introducing malware, denial-of-service attacks, or excessive automated requests
  • Scrape the Site at a volume that materially affects performance for other users (modest, considerate scraping for personal research is acceptable)
  • Reverse-engineer or copy substantial portions of the Site’s calculator logic to deploy as a competing product
  • Use the Site to provide tax-preparation services to third parties as a paid service while representing the calculator’s output as professional advice
  • Misrepresent calculator results as having been issued or endorsed by any government authority

7. Intellectual property

The Site’s design, written content, calculator logic, code, layout, and brand identity are owned by LandTaxCalculator.com and protected by copyright and other intellectual property laws. You may:

  • Take screenshots of calculator results for your own records or to share with your accountant or lawyer
  • Quote short passages from the Site’s written content with attribution and a link back to the Site
  • Embed or link to the Site in non-commercial contexts

You may not republish substantial portions of the Site’s content, replicate the calculator interface, or use the Site’s brand identity (logo, name, visual style) in a way that suggests endorsement or affiliation, without our written permission.

8. Third-party links

The Site contains links to third-party websites — primarily official government sources cited as references for the rates used. We provide these links for your convenience and verification; their inclusion does not imply endorsement. We are not responsible for the content, accuracy, availability, or privacy practices of any linked third-party site. You access third-party sites at your own risk.

9. Disclaimers

The Site is provided “as is” and “as available”, without warranty of any kind, express or implied. To the fullest extent permitted by law, we disclaim:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Any warranty that the Site will be uninterrupted, secure, error-free, or free of viruses
  • Any warranty that calculation results will be accurate, complete, or current at the moment you view them
  • Any warranty regarding suitability of the Site or its results for any specific transaction or decision you may make

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, LandTaxCalculator.com, its operators, contributors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages — including (but not limited to) loss of profit, loss of business, loss of data, or unanticipated tax liability — arising from your use of, or inability to use, the Site or any calculation it provides.

Our aggregate liability to you for any and all claims arising out of or in connection with the Site is limited to the amount you have paid us to use the Site, which (because the Site is free) is zero. This limitation applies regardless of the legal theory of the claim — whether contract, tort, statute, or otherwise.

11. Indemnification

You agree to indemnify and hold LandTaxCalculator.com harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from your misuse of the Site, your breach of these Terms, or your violation of any law or third-party right in connection with your use of the Site.

12. Changes to these terms

We may update these Terms from time to time. When we do, we’ll change the “last updated” date at the top of this page. Material changes will be flagged more visibly. Continued use of the Site after a change constitutes acceptance of the updated terms; if you don’t agree to the changes, please stop using the Site.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which the Site’s operator is established, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts in that location, except where applicable consumer protection law in your jurisdiction grants you the right to bring proceedings locally.

Nothing in these Terms is intended to limit any non-waivable rights you may have as a consumer under applicable law (for example, under the Australian Consumer Law, Canadian provincial consumer protection statutes, EU consumer directives, or the UK Consumer Rights Act 2015).
